During what should have been the happiest days of our lives following the birth of my son, my family was subject to the mental anguish of frivolous litigation. Whenever a legal problem arises, Mr. Luthmann is always the first call I make. Fortunately, there have only been four instances that demanded his assistance, but he always has an answer ready as to how I should handle the immediate circumstance, and what steps I should take moving forward. It never ceases to amaze me how little effort is required on my part upon involving Mr. Luthmann’s services. On three of the four instances, the problem just disappeared. I neither had to send in a letter, or even appear in the state. He had represented me in court and got the charges dropped and the fines expunged. On the fourth instance, a moving violation, he read all of the fine print and suggested that I pay the fine. His research was dead on: the points did not transfer back to my home state (i.e. driver’s license), and the fine negated the need to fly back for a court date. To the best of my knowledge, Mr. Luthmann’s record is impeccable. He goes out of his way to learn the necessary state’s laws’ loopholes and keep me, the client, from having to do any legwork. US Taxpayers with Assets Abroad

For natural persons, a “US Taxpayer” is generally a person who is either a US citizen or permanent resident or who is physically present in the United States for 183 days or more in a taxable year. Beginning with the Swiss bank leaks of 2007 and 2008, we have seen the beginning of the end of international bank secrecy. Now, US Taxpayers with unreported assets in foreign countries now subject to reporting are at risk of potential IRS criminal prosecution. In light of recent developments, specific countries (notably India) can be labeled as “high risk.” Last year’s HIRE Act legislation signed by President Obama requires all Americans to disclose their assets in foreign countries. This reporting is a precursor to exchange controls which are to be implemented in the US. Starting this year, US Taxpayers owning foreign assets must file a new annual statement to the Department of Treasury in addition to already-required disclosure (notably the TD F 90-22.1 Report of Foreign Bank and Financial Accounts or “FBAR” Form and the Form 3520 Foreign Gift and Trust Reporting Form). The new Form 8938, Statement of Specified Foreign Financial Assets, will need to be attached to your 2011 tax return. Reporting is required in taxable years beginning on or after January 1, 2011. Now is the time to engage in tax planning if you have assets that are potentially reportable. As is clear from Form 3520, not even the traditional Foreign Trust is free from scrutiny, information reporting and potential client liability (civil and criminal). The IRS offers amnesty programs which taxpayers may want to utilize to avoid the harshest applicable penalties.
